Terms

General:

These sales conditions apply to all sales of goods and services from www.gurudiscgolf.no to consumers and retailers. Sales conditions, together with your order as confirmed by an order confirmation, form the contract of purchase.
If you are under 18 years old, you can only pay cash on delivery or pay on delivery. You can also get a responsible adult, such as a legal guardian, to make the purchase for you.

Consumer purchases are regulated in forbrukerkjøpsloven, angrerettloven, markedsføringsloven, personopplysningsloven, e-handelsloven og kredittkjøpslovenFollow links to these laws if you want more information about your rights and obligations when buying.

Where conditions of sale require written confirmation, this is fulfilled by the use of e-mail or text message to a mobile phone (SMS).

Order:
Your order is binding when the order is registered with us. We are similarly bound by your order if it does not differ from that which is advertised by us in our web-shop, marketing or otherwise. You still have the right to withdraw from the purchase in accordance with the cancellation law.
When we receive your order, we will confirm the order and automatically send a confirmation to you. Carefully read the order confirmation when you receive it and ensure is in compliance with your order.

Discrepancies between your order and the order confirmation are considered as new offer from us, which you can accept or turn down. You still have the right to invoke your original order if this is consistent with that which we have offered. Exceptions may occur.
 
Information provided in the online store:
Guru Disc Golf try to give our customers the correct information about our products as far as possible. We do however reserve the right that typing and printing errors may occur, which may mean that we cannot deliver according to the information given in our web-shop, marketing or otherwise.
Furthermore, we reserve the right to cancel your booking or part thereof, if the product is sold-out. Should this occur, you will be notified of this, together with information about what we can offer instead. You will have the opportunity to accept our new offer with the changes made in relation to your order, or cancel the order.
 
Prices:
Consumer:

Prices on gurudiscgolf.no are quoted in NOK and include VAT. Prices on gurudiscgolf.com are quoted in EUR and exclude VAT.
Total cost of purchase will appear before ordering and include all expenses associated with the purchase, such as postage, freight, packaging, etc.
 
- Prices are constantly changing and we therefore reserve the right to make price changes resulting from changes in prices from our suppliers.
 
- Any change in price occurring after the time of ordering through no fault (see below) is not retroactive. If there has been any typing or printing error of significant size on behalf of Guru Disc Golf, in advertisements, etc. and/or online, Guru Disc Golf may unilaterally modify, delete or reject orders. This applies even if the customer has received an order confirmation or the like. Such errors must be corrected within a reasonable time after the defect is discovered.

Payment:

The purchase price can, at your own choice, be settled through cash on delivery or credit/debit card. All orders received with the option of an invoice are assessed for creditworthiness.When payment is made by card, the purchase price will be reserved upon placement the order. The card will be charged on the day shipment is made.
Unclaimed and non-paid packages will be charged a fee of 150 NOK + shipping plus  the return of the order, to cover our expenses.
In the event of non payment, after prior notification, the overdue amount will be sent to a collection agency. 

Delivery and delay:

Delivery of products we have in stock takes 4-8 business days after the order date, indicated on the order confirmation. We assume the risk for the goods until assumed by you, that is, when you have received the products in your possession. If delivery of the goods is delayed, we will provide you with information as soon as we have knowledge of it, together with information about when delivery will take place, or if the product(s) are sold-out. Depending on the nature of the goods and length of delay, you can in some circumstances withhold payment, demand delivery, claim damages or cancel the contract.
- We reserve the right to refuse delivery on all items as a result of fluctuations in price and/or inventory situation. We also reserve the right to refuse delivery on all items on the basis of competitive conditions and all other causes.
- All delivery times given by us must be regarded as indicative. Time for picking, packing and eventual production will apply before we submit the parcel to the carrier.
- Courier time always comes in addition. We reserve the right to change or modify the stated delivery time without further notice.
 
Examination of products:

After you have received the products, you should, as soon as you have opportunity, examine whether the delivery complies with the order confirmation, the products have been damaged during transport or for any defects or deficiencies.

Tollpost:
 
If the item is damaged during transport by Tollpost, proceed as follows:

The receiver shall note the damage on the driver's hand terminal/consignment notes.
Provide evidence via photo(s) (both packaging and item).
Contact Tollpost customer service immediately by phoning 09300.
Leave the goods and packaging intact until the matter is resolved.

The following information must be included:
Photos of the damage.
Order Number.
Tollpost reference numbers.

Posten (CarryOn Homeshipping):

If the item is damaged during shipping with Posten, proceed as follows:

You must retain both the packaging and products.
Register a return via nettbutikk@sunesport.no.
Once you have received approval for the return go to the post office with the damaged consignment and packaging.
At the post office fill in a damage notice/claim form.
Send the form to Sune Sport AS with the approved return from Sune Sport AS along with the damaged item.
The legislation refers to that doing things "within a reasonable time" and we allow ourselves to interpret this in the context regarding when you have retrieved/received product.
 
Complaints - Consumer Act of June 21 Number 34 2002:

If an error or defect is detected, the consumer must, within a reasonable time after he or she discovers it, or should have discovered it, give the seller notice that he or she will claim for the defect (complaint). The deadline for complaints is in any event not less than two months from the time the consumer discovered the defect. Complaints must be made no later than two years after the consumer acquired the goods. If the goods, or any part thereof, during normal operation is supposed to last considerably longer, the time limit for complaints is five years. If the consumer fails to complain in time, he loses the right to claim against the deficiency. A deficiency showing up within six months after the consumer took over the risk for the goods (normally the time of delivery) shall be presumed to have existed at the transfer of risk.

Notification of errors or defects in products may be made to us orally or in writing. For the consideration of evidence, we recommend that the complaint is submitted in writing, by letter or email. Contact information can be found under "Contact us” at www.sunesport.no. Confirmation of receipt of a complaint inquiry will be received via mail to the address that the customer has registered in their customer profile.

If there is a defect of the goods and the consumer has made a complaint within the stated deadline, the consumer can invoke these mangelsbeføyelser:
 
- Withhold payment
- Under certain circumstances choose between repair or replacement
- Demand cancellation if the defect is not immaterial (assumption that the item is in the same condition and quantity)
- Require replacement
 
If the seller's repair or redelivery results in the consumer being prevented from using the item for more than a week (we interpret this as running from the time the item(s) are received at Sune Sport AS) the consumer has, under certain conditions, the right to demand a replacement, subject to availability at the seller's expense. As a rule, the seller is not required to make more than two attempts at correction or replacement of the same deficiency.
 
If there is a defect, the seller may only charge fees for investigations that have been necessary to determine whether there is a flaw, and payment for the repair of the goods if the seller has made the consumer expressly advised that he or she must cover such costs.
 
If the customer at their own initiative takes measures to correct a fault which had to be agreed with Sune Sport AS, Sune Sport AS will not cover these expenses.
 
Warranty:

Our warranty does not imply any limitations in the claim deadline for goods according to consumer law.
 
Right of cancellation:

Angrerettloven gives you the right to cancel your purchase. Cancellation rights apply to goods and for certain services (see the exception in the last paragraph).
Cancellation rights assumes that within 14 days after you receive the delivery you give us notice (cooling off period).
If you have not received a return form, either in the order confirmation or with the delivery of the products, this deadline is extended to three months.
For the right of withdrawal to be applicable, the product must be delivered to us in virtually the same condition and with the same amount as you received it.
All products must be returned to us within a reasonable time. Any return shipment must be paid by you. You assume the risk of transport back to us. We are obliged to refund to you what you paid, including the postage for shipment to you, handling, customs fees, collection charges, etc. This applies only when the full purchase price is returned. Repayment will take place within fourteen days after we receive the product from you.
The product is to be returned to us in the original container or equivalent, along with the return form. For details on how you use the right of cancellation, please see the return form.
 
Personal Information:

Our customers are concerned that we handle personal information in a secure manner. The following sections provide a detailed description of how we handle this information.
When you shop with us we keep, amongst other details, name, address and e-mail. This is information we need to deliver the goods to you via the carrier you choose, as well as contact you about matters related to the order. We are also obliged to keep this information in relation to accounting, duty handling and any possible warranty/returns handling, so this information cannot be deleted. This information is also available in "my account".

Card numbers are not retained by Sune Sport AS beyond what is necessary to ensure effective handling of any problems with the charging, cancellation or refund.

We also collect and store log data regarding which categories and products visitors are looking at or searching for to be able to learn what our customers are interested in, as well as to improve our product choice and offers. This information is also used to make it possible to show you related products or send you related offers (if you have explicitly asked for this).
We provide an e-mail subscription to receive various kinds of information and offers. It is voluntary to receive these and you must enrol at registration or via "My Account". It is also easy to sign off the email listings from your account page.

Sune Sport AS will not sell personal information to third parties, and we neither exchange or forward nor information with third parties.

Sune Sport AS is responsible for processing personal data as described above.
 
Sales Pant:

We have a pant on the delivered products until the purchase price, including interest and costs, is paid in full.
Sune Sport AS has a pant on the sold goods as security for its claim for the purchase price plus interest and costs, ref. pantelovens 3-14 flg. Only businesses and government agencies can buy goods on credit, and this will be agreed before the credit invoice dispatch.
 
Customer's obligations:

Whoever is registered with Sune Sport AS is liable for payment of the services Sune Sport AS or Sune Sport AS’ partners supply under these conditions. This responsibility includes others' use of customer access, including unauthorised use, unless it can be proven that the unauthorised use was made possible through the negligence of Sune Sport AS.
 
Extraordinary circumstances:

Sune Sport AS is only responsible for loss of the item should there be a fault or deficiency. This does not apply if Sune Sport AS proves that the breach is due to circumstances beyond Sune Sport AS’ control, and that Sune Sport AS cannot reasonably be expected to avoid or overcome the consequences.
 
Sune Sport AS is not responsible for indirect losses due to defects unless the loss was caused by gross negligence or wilful misconduct by Sune Sport AS.
 
End-user terms cannot be inferior to the terms set by law. Lov om forbrukerkjøp av 2002-06-21 nr. 34. 

Change in terms:

Sune Sport AS reserves the right to change the terms and conditions as a result of changes in legislation.
 
Force majeur:

If Sune Sport AS is prevented from delivering, or is obliged to make a redelivery, or should such a delivery be unreasonably burdensome due to a labor conflict or other circumstance when the parties have no control over it, such as fire, war, mobilisation or unforeseen military call-up of similar scope, requisition, confiscation, currency restrictions, riots and civil commotion, shortage of transport, general shortage of materials, reduction in the supply of power and defects in or delays of deliveries from subcontractors or manufacturers, as a result of such circumstances described in this paragraph, Sune Sport AS is exempt from all other responsibilities other than in the cases of complaints or credit for the faulty items corresponding purchase price.
 
Disputes and Governing Law:
    
Disputes over the terms and related provisions, as well as disputes relating there in and resultant legal matters fall under the auspices of the civil courts.
